Where you are, and what to do now

Find your situation. Every service below is free.

  1. You have a court date, or a letter about a desnonament

Go to your district Oficina de l’Habitatge and ask for SIPHO. Go before the date, not after — almost everything that can be done has to be done before the hearing.

  2. You have nowhere to sleep tonight

CUESB is the city’s social emergency team. Free, day and night.

  3. Your electricity, water or gas is cut, or you have a cut-off warning

Call a Punt d’Assessorament Energètic on 93 000 80 54. They can stop a cut-off while your case is looked at.

  4. Someone wants money before you have seen the room

Stop. Work through the checklist below before anything is paid.

  5. You moved out and your deposit has not come back

It must be returned within one month of handing over the keys.

  6. You think your rent is too high for a capped city

Barcelona is a rent-capped zone. There is an official index you can check.

  8. You live in your employer’s home

Two rules protect what you are paid and where you must be after work.

Before you pay anything

Screenshot this. Work down it in order — the order is what protects you.

  1. See the room in person. Not a video call, not photos. Go inside.
  2. Meet the person letting it. Ask for their ID, and for something showing the flat is theirs to let — an IBI receipt, a deed, or their own rental contract if they are subletting.
  3. Get the contract in writing before any money moves. Both names, the address, which room, the rent, what the rent includes, the start date, how long it lasts.
  4. Check what the rent includes. Water, electricity, gas, internet, community charges — written down, not agreed out loud.
  5. Check the rent against the official index. Barcelona is a rent-capped city: serpavi.mivau.gob.es
  6. Ask what the last tenant paid. The owner or agency must tell you and it must appear in the contract. Leaving it out is an infringement.
  7. Pay the deposit only when you sign, and get a receipt. One month’s rent for a home or a room.
  8. Pay no agency fee. Agency and contract costs are the landlord’s, by law.

Never send money before you have seen the room in person and have something in writing. A landlord who is “abroad”, who cannot show you the room, who will not meet you, and who wants a reservation payment today is running a known scam on newcomers. There is no reservation that has to be paid before a viewing.

If you already paid: report it to the Mossos d’Esquadra as an estafa. Any comissaria, 24 hours, every day. Appointments can only be booked online at mossos.gencat.cat, and you will still be seen without one. Report it as soon as you know, even if it happened days ago. Online reporting is only for commercial businesses, so you have to go in person. Emergency: 112.

Renting a room

Most people in this community rent a room rather than a whole flat. Room rentals used to sit outside a lot of the rules. That has changed twice in 2026.

What a room rental is

A contract where the owner gives you exclusive use of one room, plus the right to use the shared parts of the flat, for a price. That is the definition Barcelona City Council uses.

What a lawful room contract states

  • Both parties and their ID numbers.
  • The address, and which room.
  • The rent, what it includes, and the deposit.
  • How long it lasts, and how it renews.
  • Who pays which bills.
  • For a Barcelona contract signed from 1 January 2026: the price allowed by the reference index, the rent the previous tenant paid, and whether the owner is a gran tenidor.

From 14 July 2026, the deposit on a room rental must be registered.Contracts for renting a home by rooms — and any other arrangement that splits a home up physically or by contract — signed on or after 14 July 2026 must have the legal deposit paid to INCASÒL and entered in the Deposit Register.

This is your landlord’s duty, not yours, and it must be done within two months of signing. For you it means three things: your deposit sits with a public body instead of with your landlord; you can ask INCASÒL whether it was actually registered; and a landlord who refuses is breaking a rule you can point at.

If the person letting you the room is a tenant, not the owner

They need the owner’s written consent to sublet. Without it the sublet is not valid and it can end the whole tenancy — including yours. The sublet price can never be higher than the rent for the whole flat.

Stays of 31 days or less are presumed to be tourist lets, which need a licence. If someone offers you a “monthly” room on those terms, ask which contract you are actually signing.

The deposit (fiança)

How much deposit is lawful
ContractDeposit
A home you live in permanently1 month’s rent
A room, a sublet, or a shared-out home1 month’s rent
A temporary rental for work, study or medical reasons1 month’s rent
Non-housing use, or where the tenant is a company2 months’ rent
  • On top of the deposit the two sides may agree an additional guarantee, which cannot be more than two months’ rent.
  • Separately from both, a landlord cannot ask for more than one month’s rent in advance.
  • Agency fees and the cost of drawing up the contract are the landlord’s. Charging them to you is classed as a very serious infringement.

Who holds it — and the two deadlines that are your landlord’s, not yours

Where your deposit goes, and when it must come backA four-stage timeline. You pay one month’s rent when you sign. Within two months your landlord must lodge it with INCASÒL and register it. When you hand back the keys the return clock starts. Within one month of the keys the deposit must be back, and after that you can also claim legal interest. The second and fourth stages are your landlord’s legal duties and each has a deadline. You sign and payOne month’s rent for a home or a room.Ask for a receipt on the day.Within 2 monthsYour landlord must lodge it withINCASÒL and register it. You can askINCASÒL whether that was done. You hand back the keysThe return clock starts on this day.Within 1 month of the keysThe deposit must be back. After thatyou can also claim legal interest.Filled = your landlord’s duty, with a deadline.
In words: you pay one month’s rent when you sign. Within two months your landlord must lodge it with INCASÒL and register it — you can ask INCASÒL whether that happened. When you hand back the keys the return clock starts. Within one month of the keys the deposit must be back in your hands; after that you can claim the legal rate of interest on top. The two dated steps are your landlord’s duties, not yours.

Registration takes about 15 days. Either party to the contract can ask INCASÒL for an information certificate showing whether the deposit was actually lodged — email [email protected] with your contract details.

Getting it back

Your landlord must return the deposit when the contract ends. If a month has passed since you handed over the keys and it has not come back, you can demand the legal rate of interest on top.

Your landlord may keep part or all of it only where you have broken the contract — damage beyond ordinary use, unpaid rent, unpaid bills — and that has to be justified, normally with invoices, quotes or unpaid receipts.

If it is not returned

  1. Ask in writing, in a form that proves it arrived. A burofax is the usual way.
  2. Take the contract, the receipts and that written request to your Oficina de l’Habitatge. Their legal service is free, and the same offices mediate between landlords and tenants.
  3. If that does not work, the claim goes to court. Whether a particular deduction is justified is a legal question — ask the office, not the internet.

Unverified: whether a rental-deposit dispute can go to consumer arbitration instead. Both official sources describe the route as written demand, then court, with free mediation at the Oficina de l’Habitatge in between — which is what is written above.

Is my rent lawful?

Barcelona is a declared tensioned-market zone — a zona de mercat residencial tensat. Rent limits have applied in the city since 16 March 2024.

How long it lasts. A declaration runs three years from the day it takes effect, and can then be extended year by year. For Barcelona that three-year period ends on 16 March 2027 unless it is extended. Check the Generalitat’s list before you rely on it — the list of declared municipalities.

Unverified: whether the declaration has been extended past 16 March 2027. No extension notice was found. This page states the rule and the date and asserts nothing about whether the zone will still exist after it.

The rules for a new contract

  • The rent may be no more than the rent on the last receipt of the contract in force in the previous five years, updated by that contract’s own update clause.
  • If the owner is a gran tenidor, the rent must also be below the reference price index. Both limits apply and the lower one wins.
  • If the home has not been let in the last five years, the index applies, whoever owns it.
  • Rooms and temporary rentals are covered too, for contracts signed from 1 January 2026.

A gran tenidor is a person or company with more than 10 dwellings or more than 1,500 m² of residential floor space, or with 5 or more dwellings inside a tensioned zone.

What the owner has to tell you

Adverts, offers and contracts must state the price under the reference system, the rent under the previous contract, and whether the owner is a gran tenidor. From 26 March 2026 a report from the state reference system (SERPAVI) has to be attached to the contract when the deposit is lodged — so you can ask to see it.

How to check your own rent

  1. Reference price for the flat: serpavi.mivau.gob.es
  2. Annual increase calculator: mivau.gob.es · calculadora
  3. Whether the town is still declared: habitatge.gencat.cat · llistat ZMRT

If the rent looks wrong. You can report a breach of the rent-containment rules at gencat.cat · Sancions Decret llei 1/2025. Fines run from €9,001 to €90,000 for a serious infringement and from €90,001 to €900,000 for a very serious one; a rent set more than 30% above the maximum is in the top band.

Whether your rent is unlawful is a question for the free legal service at your Oficina de l’Habitatge, not for a website.

Not covered by the cap: officially protected housing, homes in public social-rental or mediation networks, obligatory social rentals, and tourist-use flats.

Your rights as a tenant

For a contract signed from 6 March 2019. Older contracts follow the rules of their own date, and contracts from before 1 January 1995 need a specialist — the Oficina de l’Habitatge has one, free.

Rental contracts under the Ley de Arrendamientos Urbanos
How long it lastsYou can agree any length, but if it is shorter than 5 years it extends automatically, year by year, until it reaches 5 — or 7 years if the landlord is a company.
After thatIf neither side gives notice it extends again, year by year, for up to 3 more years.
Extra time in BarcelonaBecause the city is a tensioned zone, a further extension of up to 3 years, one year at a time, can apply. Whether it applies to you is for the Oficina de l’Habitatge to say.
Notice not to renewLandlord: 4 months. Tenant: 2 months.
Leaving earlyAny time after 6 months, with 30 days’ notice. The contract may set compensation of at most one month’s rent for each year still to run.
Rent risesOnce a year at most, on the contract’s anniversary, and only if the contract says so. With no clause, there is no increase. For contracts signed from 26 May 2023 the ceiling is the IRAV / IRAH index.
When a rise appliesThe month after it is notified to you in writing, stating the percentage.
RepairsYour landlord pays for whatever keeps the home habitable, at no extra rent — including the boiler and hot water, damp from leaks or bad pipes, and windows in a state that lets water or air in.
Small repairsWear and tear from ordinary use is yours.
Long repairsIf conservation work lasts more than 20 days, the rent goes down in proportion to the part of the home you lose.
Improvement works3 months’ written notice. You have 1 month from that notice to end the contract, and a right to a rent reduction and compensation for costs the works force on you.
IBI and community chargesOnly if it is written into the contract and the yearly amount is stated. In a new contract in a tensioned zone, charges that were not in the previous contract cannot be added.
ReceiptsYour landlord must give you a receipt for every payment, itemised, showing the rent in force.
How you payElectronically as standard. If you have no bank account you can ask to pay in cash at the home.
What you must be givenThe cèdula d’habitabilitat or equivalent, and the energy performance certificate.

Unverified: the current IRAV / IRAH percentage. The index is named and its role explained, but no number is printed here — a stale percentage is worse than none. The INE publishes the current value.

Unverified — and the reason there are no street addresses here: the ten Oficina de l’Habitatge addresses could not be read from an official page. The council’s directory renders its list from a map service that returns nothing to a plain request, so this page links the directory, the booking page and 010 rather than print an address that might send you to the wrong door.

Behind on rent, or facing eviction

Go before the court date, not after. The deadlines in an eviction are short, and almost everything that can be done has to be done before the hearing. Once a llançament date is set, the options narrow sharply.

  • First stop: your Oficina de l’Habitatge. They mediate between you and your landlord where the problem is money — arrears, debt, a claim already filed — aiming at an agreement that keeps you in the home and deals with what is owed. They also handle landlord harassment.
  • Ask for SIPHO. It accompanies households already in an eviction process, explains the rights the law gives you, and — where no agreement is possible and the eviction date arrives — carries out the final negotiations and goes with the family.
  • Emergency payments exist for people in an eviction process who hold a rental contract or are looking for a home, with a renewal for people who received one the year before.
  • Rehousing. The Mesa d’Emergències, set up by the City Council and the Generalitat, can allocate emergency housing in the cases its rules cover.
  • Nowhere to sleep tonight: CUESB, 900 703 030. A specialist team, free phone, for emergency temporary accommodation.
  • A lawyer for the court case: apply for assistència jurídica gratuïta.

Whether an eviction can be stopped in a particular case is a legal question. Take the papers to the Oficina de l’Habitatge and ask for the legal service — do not wait to see what happens.

Help with paying the rent

Grants run in rounds. A round is called a convocatòria, and each one has its own eligibility rules, its own list of documents, and its own opening and closing dates.

Seeing a grant listed does not mean it is open, and it does not mean you qualify. The city’s grants page shows open and closed rounds side by side. Always open the current convocatòria and read its conditions before you prepare anything.

Rounds that have run in Barcelona include the Bo de Lloguer Jove; rent subsidies for people aged 36–64 and for people 65 and over; grants for people in an economic and social emergency; grants for specific groups such as single-parent families and people over 55 living alone; payments arising from mediation; and renewals for people who received a grant the previous year. Which of these is open today changes.

Unverified: which rounds are open today. The rounds above are described as rounds that have run, never as open ones. Only the official page can tell you what is open now.

Apply through, or ask at, your Oficina de l’Habitatge. Current rounds: barcelona.cat · ajuts al lloguer and habitatge.gencat.cat · ajuts.

Registering where you live

You can register without legal residence in Spain. Barcelona says so directly: to be entered on the padró, no cal tenir residència regular al país.

Why it matters. Registration opens the door to public healthcare and to a school place for children, and it is required for most immigration procedures — family reunification, arrelament social. It is also a condition of the electricity bo social.

A landlord who refuses to let you register is blocking your healthcare and your children’s school place. That is what is at stake, and it is worth saying out loud when you ask.

If you have no papers for the flat

You can still apply at an OAC (Oficina d’Atenció Ciutadana). After the application you will get a phone call and then a check visit from municipal staff, who confirm that you live there. This route does not need your landlord’s signature.

If you have no fixed address

Empadronament sense domicili fix covers people who are sleeping on the street, in emergency temporary accommodation, who do not live continuously at one address, or who live somewhere they would be thrown out of if they asked to register there — which is exactly the position of many people in sublets and rented rooms.

  1. You need an Informe de Coneixement de Residència (ICR) from Serveis Socials.
  2. If you already use social services, ask them. If you do not, ask at an OAC or at the OPSE (Oficina de Prestacions Socials i Econòmiques).
  3. You are then registered at the address of a municipal centre, where your post will arrive. The council describes this route as exceptional.

Where to ask: call 010, go to any OAC, or use the Oficina Virtual de Tràmits. Full guidance from the City Council. Our short answer on the padrón →

Water, electricity and gas

Getting the supply into your name

If the contract is in someone else’s name — a former tenant, or your landlord — you can ask the supplier for a change of account holder. You will be asked for the supply point details, which are on any recent bill, so ask for one before you move in. A PAE will walk you through it.

The bo social

A discount on your electricity bill of 25% or 40%, depending on your income. To get it you need:

  • the electricity contract in your name, with one of the regulated-market suppliers;
  • a contracted power of 10 kW or less, on a domestic contract;
  • the PVPC tariff;
  • and to be registered on the padró at the address being supplied.

If the contract is not in your name, or is not with a regulated supplier, both changes can be requested at the same time as the bo social, and the switch is automatic and free.

They cannot cut off a vulnerable household

Llei 24/2015 forbids supply companies from cutting off vulnerable households, and obliges them to keep the service on for as long as the financial difficulty lasts.

  • An unpaid-bill notice is not a cut-off. It tells you an invoice is outstanding, nothing more. If you cannot pay it, contact your district PAE.
  • A cut-off warning. Before cutting anything off, the company has to check that the non-payment is not caused by lack of money. Contact a PAE whether or not you use social services: they assess your situation and stop the cut-off while the process runs, and once the risk of residential exclusion is confirmed they issue the report that suspends any interruption order. A year later the company may ask you to show the situation still applies.
  • Already cut off. Contact your district PAE. They help restore the supply and process the report.

PAE: 93 000 80 54. Mon–Fri 9:00–14:00; outside 1 May – 30 September, also Thursdays 15:00–18:30.

Unverified: water-specific social tariffs. Water is covered here through the PAE, which the council’s own page says handles llum, aigua i gas. Any separate discount from the water company was not checked — ask the PAE.

If you live where you work

For live-in domestic workers and carers — internas. Your home and your job are the same arrangement, so losing one can mean losing both. Two rules are worth knowing exactly.

Accommodation can be part of your pay, but only up to a point. Where you are given lodging or food as part of your wages, a percentage may be discounted for them only if you are still paid, in cash, at least the salario mínimo interprofesional each month — and the total discounted in kind can never be more than 30% of your total salary.

When the working day ends you are not obliged to stay in the house. Once the daily working day is over — and any agreed tiempo de presencia with it — you are not required to remain in the family home.

Register on the padró. It is what carries your healthcare and your children’s school place across a change of job. If you cannot register at your employer’s address, or asking would put your job at risk, the empadronament sense domicili fix route with an ICR exists for exactly that situation — see Registering where you live.

The two rules above are the accommodation part. Contracts, hours, Social Security, dismissal and the salario mínimo interprofesional are not covered anywhere on this site yet, so there is nothing here to send you to — take those questions to a union or to the free legal service at your Oficina de l’Habitatge.

The legal deposit. One month’s rent for a home or a room. In Catalonia your landlord must lodge it with INCASÒL, not keep it.
arres · paga i senyal
Earnest money — properly a term from buying a property. In a rental, what people call a “reservation” is a payment on account, and beyond the deposit and any agreed guarantee a landlord cannot ask for more than one month’s rent in advance. Nobody should be asking for it before you have seen the room.
